How to Write a Provisional Patent with AI (free ChatGPT app)

In this post I will show you how to write a provisional patent with AI using our free ChatGPT App. A Provisional Patent Application (PPA) is a fast, low-cost way to file your invention with the US Patent Office (USPTO) and secures 12 months of patent application pendency. During this 12 month pendency period, you can label your invention as ‘patent pending’. Most importantly, if prepared and filed correctly, it secures an early filing date with the USPTO, which is critical to establish your priority ahead of other people working in the same area. Unlike a the non-provisional application (sometimes called the “utility patent application”), a PPA has fewer formal requirements and lower filing fees, making it a practical first step for many budget minded inventors.

Remember, the PPA is not the same as having an issued patent. To obtain an issued patent you must file a non-provisional patent application within 12 months of your PPA and wait until that is approved by the US Patent Office.

Why Write Provisional Patent with AI?

Today, most advanced patent law firms have at least one AI patent drafting tool to assist them. Using a tool to write a provisional patent with AI, like the one powered by ChatGPT, can save you thousands of dollars in legal fees but comes with risks and few drawbacks. AI tools have gotten quite good at routine tasks and can build patent applications that look and read well but unless you are an experienced patent drafter, they may also give you a false sense of security. We always recommend you have an experienced patent attorney or patent agent at least review AI generated applications before final submission to the US Patent Office.

Introducing Patent Creator Pro: How to Write Provisional Patent with AI for Free (GPT app)

We built a free GPT app (it runs inside ChatGPT by OpenAI) and it is designed to turn your user notes and uploaded files into a properly formatted provisional patent application (PPA). This tool allows you to write provisional patent with AI, making the process easier than ever. With this ChatGPT patent application tool, you can skip the struggles of using our older free provisional patent application template.

Step 1: Access the tool via this LINK or search inside the app store within ChatGPT for the name “PatentFile.org” to make sure you have the correct tool pulled up:

Begin by navigating to the dedicated AI patent drafting tool. This specialized GPT is trained specifically on USPTO guidelines from the Manual of Patent Examination (MPEP). Accessing a tailored interface ensures that the AI understands the nuances of patent language. Unlike general-purpose AI, this generator is optimized to produce a draft that aligns with the technical requirements of a provisional filing, providing you with a superior starting point for your intellectual property journey. WARNING: See warning below on data security and turn off model training.

Step 2: Upload your invention notes, sketches, or technical descriptions.
To make the most of out this tool, provide as much details as you can about your invention including the problem it solves, how it works (be specific) and include any photos or drawings and the tool will attempt to extract those and put them into proper patent figures. A good target is to upload at least three pages of text and at least two figures or schematics.

Step 3: Turn on the highest LLM model you have access to. Let the AI draft and format the required patent sections.

After you upload your files and/or type in your text hit the enter button or click the arrow to run the GPT.

Once your notes are uploaded, the AI will begin formatting your document into the standard USPTO structure. This includes the Background of the Invention, a Brief Summary, and a Detailed Description. During this phase, the AI enforces structural formatting that would normally take a human hours to perfect. It’s important to watch the output in real-time. If a specific technical aspect is glossed over, you can prompt the AI to expand on that section specifically, ensuring your free provisional patent template output is as comprehensive as possible. This is a complex process that may take 3 to 10 minutes to run fully

Step 4: Critically Review, Export, and File

After the AI completes the draft, your job as the inventor is to critically review every section. Check for technical accuracy and ensure that no essential features are missing. The AI provides a robust starting point, but the final responsibility for the patent’s content lies with you.

Common Mistakes to Avoid When Filing

Filing a provisional patent application is a strategic move, but it’s not without pitfalls. One of the most common mistakes is leaving out essential technical details. In the U.S. patent system, you cannot add “new matter” to an existing application; you must disclose everything upfront. Another risk is public disclosure. If you publicly share your invention before filing, you may lose your patent rights entirely. Finally, many inventors miss the 12-month non-provisional deadline. Remember, a PPA only protects your priority date for one year, its not the same as having a valid or issued patent.

Frequently Asked Questions

Is ChatGPT secure for patent ideas?

You should always be careful when sharing sensitive data online. Even typing your patent into MS Word or emailing it has some level of risk. AI tools are no different. 1. Click on your name in the bottom left and then Settings
  2. Click on Data controls
  3. Click the slider to turn off model training (see image below)

Does the USPTO accept AI-drafted patents?

There is no rule against AI drafted patents. The USPTO accepts patent applications regardless of whether they were drafted by a human, an attorney, or an AI and many law firms are using AI tools to help them with their drafting.
