Patent Questions and Advice / Protect an idea
« on: March 09, 2016, 03:08:31 AM »
I read in the patent "operable chair" a claim includes a control box which is defined by it's functions not the components ( because there are a lot of ways to make it ), so how to protect an idea without exact design or parts ?
Is that a method of making ( but he did not said that) ?
Can another person steel the idea because of that?
This is the text in the "operable chair" patent:
I claim:
1. An operable chair, comprising: ----------
a control box including:
a first controller operably connected to the operable means between the first arm and the frame, for selectively raising and lowering the first arm;
a second controller operably connected to the operable means connected between the seat and the first arm, for selectively pivoting the seat;
a third controller operably connected to the operable means connected between the second arm and the frame, for selectively raising and lower the second arm; and
a fourth controller operably connected to the operable means connected between the foot platform and the second arm, for selectively pivoting the foot platform.

Also I read in the internet :

Intellectual property (IP) is a collection of ideas and concepts, this might be a brand,
an invention, a design, a song which can be owned, bought or sold.

Hi
If I file a provisional can I claim the priority when filling in another country?
Can İ do some development after the provisional and still claim priority to it?
How can I secure my invention before I give it to a lawyer ?
Thanks

Patent Questions and Advice / Re: PCT or local
« on: September 15, 2015, 04:45:20 AM »
Thanks I think it is a good idea but I need some details about the fees and what they include?
(for USPTO Fast Track (Track I) program):
1-Micro entity filers
2-Standard fee
3-Attorney/agent time
4-Is there a reduction for the person from a developing country ?
so how much the total approximately will ( I will write the patent )?

Thank you for your help.
My idea is to have a patent from any PCT member as soon as possible so I will be able to speak with the manufacturers then I will be able to file in any other country .

Thanks,
I want the fastest way so I read that
South Africa has the advantage of being relatively low cost and very fast to grant ( 6 months ). Then New Zealand but it is more expensive.
So is USA fast-track better ?

Patent Questions and Advice / PCT or local
« on: September 10, 2015, 11:40:53 AM »
Dear friends :
Please have a look at the attached pic.
1-This is a comparison between Pct and Paris , so which is better ( faster for selling ) ?
The publication in the PCT case is after 6 months from the application , but if there is no local application
(only PCT) would it be the same or it would be longer? is the publication same like patent ?
2- I am thinking to do PCT and any fast country same time , what do you think ? what is the faster country?
3- I heard that Italy is the cheapest country for patent application , do you know how to apply?

Thank you for your help. I think I could not explain what I mean by “The idea” so let me please try again
1-Each invention claims  begins with broad claims to save the main idea itself for example the first claim of the trolley patent  application :
.( A trolley comprising:...a frame and at least two wheels connected to it)
so by this claim the inventor prevents any other person from claiming any trolley comprising the same , am I right ?
2- Is there any exception for that ?
3- What If an inventor makes a similar trolley (or adds something)  but claims it as a useful wheel chair for patients ? Can the new inventor manufacture it as a wheel chair?
4-If the  broad claims save the main idea itself to be made by any way , why the inventors write narrower  claims for one way ? (for any idea there are thousands of ways to be made but I see in each patent application detailed claims for one way)

Patent Questions and Advice / patent questions
« on: September 08, 2015, 01:32:15 PM »
Dear friends
please help  me with these questions because I can not afford lawyers cost.
1-Suppose that I added an extra wheel for  trolleys  : this extra wheel is great to prevent the trolley from rollover (overturning) but it can be added by many ways, mechanisms, materials and shapes so I can not claim all the ways, mechanisms, materials and shapes , how can I claim the idea itself ? otherwise the patent will be useless
2- can the person who claimed the original wheels prevent me form manufacturing ?
3- if the new wheel forming with the others an integrated design please answer #2 again.
4- I want an English friend to evaluate my English language , is it good enough to write a patent application ?
Thank you very much.
