Title: Provisional patent design updates. Can these new claims be made to NPP?
Post by: Njallen27 on February 18, 2019, 11:45:44 AM
I’ll make this short and sweet.

I filed for a PP almost 1 year ago (expiration date is just over 1 month from now). I have made changes to my design, enough so that I would need to make new claims when a NPP is filed. I have already made it public.

My question is, if I have made enough changes just to use the bare minimum claims on my PP, I can make new claims to my NPP due to the changes that were made correct? As long as I am referencing my PP with the original claims to the NPP with the new claims.  I understand the filing dates and when those would apply. I need to know if I am able to make the changes to the NPP however.

Thank you in advance!

Yes - the non-provisional can include the changes and updates.   Just as long as you know you will only get "credit" for the new stuff based on the date when you file the new non-provisional.
