Apparatus design problem

Apparatus design problem
« on: November 09, 2015, 12:42:21 PM »
Hi
I made a new therapy device with computer software and a basin .
The computer software has thousands of ways to be written .
The basin has no specific shape .
The device has several parts connected together but the connections can be made using many different ways.
So I can not claim a specific design of them because it is very easy to make another different design .
Can I  protect my invention by claiming a method of making a therapy device using a basin and a software ?
And a method of making the device using the main internal parts ?
 Is there another way ?
Best regards

Brad

I would make a list of the essential parts that you need and the non-essential parts.   Make sure all of the parts are included in your application but you only want to include the essential items in your claims.

The good news is that usually things like sizes, shaped, or dimensions are not going to limit you (unless you specifically claim them) so if your invention needs a "basin" by all means include the basin in your claims and you should get broad enough coverage on the basin to cover all equivalent sizes and shapes for a basin.

These information are very good but you did not answer me about can I protect the invention by claiming a method of manufacturing all items together  (device software basin) as the first claim ?
Also the device ( all the parts ) ?

Yes you can claim both methods of manufacturing and the device with basin+software.

(Disclaimer:  I don't know what your specific invention is so I cannot know if this is a good or wise claiming strategy).
