Questions regarding sb0015a and sb16
« on: October 16, 2017, 03:13:00 AM »
Hello everyone!

I want to file for PPA via EFS-web service and have some questions regarding sb0015a and sb16.
There are 3 joint inventors (I am one of them) therefore each of us is named in cover sheet (sb 16). Who amongst us should sign that form, applicant or first-named inventor?
There is column in sb0015a (certification for micro-entity status) named "First Named Inventor:". From each joint inventor such a form should be submitted. I don`t understand how that column has to be filled by the inventors who are not first named? Also, is that obligatory to give information about telephone number in sb0015a and how this form should be submitted via EFS-web service, as one pdf file or as 3 different pdf files?

Thank you.

If the "applicant" is a company than only a registered agent or attorney can sign the forms (see MPEP 4.09) https://www.uspto.gov/web/offices/pac/mpep/s402.html

If there is no company involved than I believe you can pick one of you to be the applicant which should probably be the first named inventor and that person should sign SB16.

For the micro entity form, you would fill out the first named inventor in the top section and that would list the same person in all 3 pdfs, however, each of the 3 pdfs would have to be signed by each person.  You can then either upload all 3 pdfs as separate files or you can merge them together (does not matter).
