Hi Brad,

Thanks a lot for this very informative forum!
I would like to apply for a provisional patent in US and I have following questions:

1- is there any difference (in terms of importance, fee..etc.) between patents applied by an individual or a company?
2- I know that I need to get a clearance from the country I reside in order to apply in US as an individual. Is it the same for a non-US company, i.e. the same clearance should be taken from the country that the company is from?

Basically, I am trying to decide whether to have my startup company first or my patents?

Hi,

The US Patent Office does not care if you apply as a company or as an individual so there is no need to change your status for the US process.

I do not know the rules for each country so I am sorry I cannot answer your second question.  You should check with a patent attorney in your local country to clarify this question.
