Title: Missing Documents in a Provisional Patent
Post by: Matt Roberts on August 15, 2017, 07:09:34 AM
Brad,

I submitted my Provisional Patent through the EFS online system last night and had great difficulty as the website kept refreshing and presenting errors. Finally, I was able to submit and pay my fees. Unfortunately, I noticed my specification page was not one of the listed documents that I uploaded. Is there any advice on how to add this page either via fax or resubmit through EFS?

I was hoping not to have to wait for USPTO to kick back the application via mail a few weeks from now stating missing docs.

Thanks,
Matt

If you are an "unregistered" filer which most inventors are then they only way to update the filing is to do it by postal mail.

If it were me I would just re-file everything and re-pay the fee and then see if you can get a possible refund on the first submission.
